SAP SE, Dietmar-Hopp-Allee 16, 69190 Walldorf, Germany (“SAP SE “) is Promoter of the SAP- Manchester City “Who Makes The World Run Better” contest (hereinafter “Contest”) and raffle (hereinafter “Raffle”). By either nominating a SAP & Manchester City Community Hero or consenting to participate in the Contest and Raffle as a SAP & Manchester City Community Hero yourself, you as nominator (“Nominator”) or you as nominee (“Nominee “) accept these terms and conditions to the Contest and Raffle. This promotion is in no way promoted, endorsed or administered by, or associated with Facebook, Twitter or any other Social Network.
Nominator and Nominee must (i) both be eighteen (18) years or older.
You are prohibited from participating in this contest if you are located in a country embargoed by Canada, the United States or Germany and if you are on the U.S. Treasury Department’s list of specifically designated nationals.
Individuals who are employees, officers or directors of SAP (“Promoter”) or who are employees, officers or directors of Manchester City a football club located at Etihad Stadium, Etihad Campus, Manchester, M11 3FF, United Kingdom and its respective parents, subsidiaries, affiliates and advertising and promotion agencies (collectively, “Contest Entities”), and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win.
Employees of a government of a country eligible to participate are excluded from participation.
SAP reserves the right to verify eligibility and to adjudicate on any dispute at any time. The Contest is subject to all federal, provincial, state, and local laws and is void where prohibited. Nominator and Nominee as well as Voter in the Contest and Raffle agree to be bound by these Official Rules and the decisions of the Promoter, subject to Nominee giving its individual consent in accordance with Section 4 II.
In addition, by voting for SAP & Manchester City Community Hero via any of the voting methods included in Section 3 (III) you also agree to be bound by these Official Rules.
PERIOD OF PARTICIPATION
I) Phase one - Submission
The Contest will start with a submission phase in which the Nominator can submit a proposal for a Nominee. This will be open from 14.00 (CET) on Tuesday 12 February 2019 until 18.00 (CET) on Thursday 28 February 2019.
II) Phase Two – Selection
The second phase will run from Friday, 1 March 2019 to Friday, 26 April 2019 at the end of which time representatives from the Promoter and Manchester City (hereinafter the “Jury”), will decide on three (3) Nominees, that will be presented for a public vote in the third phase.
i) The top twenty (20) Nominators will be shortlisted by an internal panel and notified by email by no later than Saturday 9 March.
ii) The Nominators will be asked to produce a supporting video entry explaining and showing how the Nominee is making a difference in their local community and why he/she should be selected (hereinafter “Entry” or altogether “Entries”). The Entry will be produced by the Nominator and the Nominee and must be submitted to Promoter by no later than 18.00 (CET) on Sunday 17 March 2019.
iii) The Jury will select the top three (3) Entries for a public vote. Nominees will be notified via email about the decision by no later than Sunday 24 March.
iv) All three (3) finalists (both nominator and nominee) will be required to complete satisfactory background checks by no later than Thursday 7 April 2019. This process will be supported by SAP and Manchester City.
v) During the period from Friday 8 April 2019 to Friday 26 April 2019, the Nominator and the Nominee will be asked to work with the Promoter in producing a Video that will then be published on the sap-mancityheros.com website, Manchester City Cityzens Portal and on social media channels of both the Promoter and Manchester City during the final voting phase (hereinafter “Video” or altogether “Videos. )
III) Phase Three – Voting
The public vote will be open from 09.00 (CET) on Monday, 29 April 2019 until 18.00 (CET) on Friday, 31 May 2019. Videos will be published on the sap-mancityheros.com website, on social websites of the Promoter and Manchester City and on the Manchester City Cityzens Portal.
Votes will be permissible via the following methods –
- Vote submission forms on the sap-mancityheros.com website
- Vote submission forms on the Manchester City Cityzens Portal
- By ‘liking’ official SAP Man City Community Hero social posts on SAP and Man City social platforms.
HOW TO ENTER (“ENTRY”) AND PARTICIPATE (“PARTICIPATION”)
Participation is free of charge and no purchase of a product or service is necessary to enter or win.
I) The Nominator must enter its proposal for a SAP & Manchester City Community Hero on the sap-mancityheroes.com website and must answer all questions displayed there about its nomination. The Nominator must also provide the Promoter with a valid email address of the Nominee, so the Promoter can contact the Nominee. The Nominator can enter a maximum of three (3) nominees.
II) The Nominee will then be contacted directly via email by the Promoter asking for its permission to be part of the Contest and Raffle for the Promoter to be able to use and publicize its personal data and for the Nominee to accept the Official Rules to the SAP- Manchester City “Who Makes The World Run Better” Contest and Raffle. Only if the Nominee gives its individual consent, the Nominee will be able to take part in the Contest as the SAP & Manchester City Community Hero.
III) If the Nominee declines, all personal data of the Nominee will be deleted and neither the Nominator nor the Nominee may take part in the Contest.
IV) The top 20 (twenty) nominators and their nominees will be asked to produce a supporting video entry explaining and showing how the Nominee is making a difference in their local community and why he/she should be selected that will serve as the basis for the Jury to pick three (3) finalists.
V) Further on, if the Nominee is chosen to for the final voting round, both the Nominator and the Nominee will be asked to work with the Promoter in producing a Video that will then be published on the sap-mancityheros.com website and on social media channels of both the Promoter and Manchester City during the voting phase.
VII) Further, by entering this Contest, the Nominator and the Nominee hereby represent, warrant, and covenant (as applicable), and agree to produce written evidence of such if requested, that:
A) The Entries, in whole and in part, do not violate or infringe upon any proprietary or intellectual property rights, including copyrights, trademarks, patents, trade secrets, industrial property rights, personal or moral rights, or any other rights whatsoever of any person and/or entity;
B) The Entries, in whole and in part, are submitted to the Contest by or with the permission of all persons (living or deceased), venues and/or entities who worked on, were engaged to work on, or contributed in any respect to the entry or any part thereof, who are depicted (directly or indirectly) in the entry by name, likeness, voice, image or any other information or indicia of persona, or who otherwise have any right, title and interest in and to the entry or any part thereof (including but not limited to rights arising from a work for hire relationship), and all such persons, venues, and/or entities have provided their written consent to submission for purposes of the Contest and its use pursuant to the Official Rules;
C) The Nominator and the Nominee has all other rights, licenses, permissions and consents necessary to submit the entry and to grant all of the rights granted to the Promotor in these Official Rules (and in any related agreement entered into by Entrant), and the exercise thereof by the Promotor and/or the use by them of the rights granted by Entrant, in whole or in part, does not and will not give rise to any alleged or actual claims, disputes, actions or liabilities, including but not limited to those for disputes or payment of any kind, including without limitation royalties, residuals, attribution, credit, dues, consultation or any other fees, costs, or expenses;
D) The Entry is truthful and is not based on false information but verifiable objectives about any project, activities, associations and persons;
E) The Entry, in whole or in part, contains no malware, including viruses, trojans, worms, spyware or any other harmful software, code or other devices; and
F) The Entry, in whole or in part, contains no pornographic, sexually explicit (including nudity), defamatory, offensive, violent, discriminatory, cruel, abusive, highly sensitive, or illegal content (including but not limited to gambling (in China), and/or technology or other content that is prohibited from export), content of an obscene or menacing character, and does not otherwise offend against reasonable standards of taste and decency.
VIII) Entries will not be acknowledged (except as set forth herein) or returned, and no correspondence will be entered except as set forth in these Official Rules. The Promoter’s administrator’s database clock will be the official time-keeper for this Promotion. Standard Internet access and usage charges imposed by your online service provider may apply to Entries. If you opt to use a wireless mobile device, data rates may apply. Other charges may apply; check your mobile plan for rates/details.
IX) The Promotor is not responsible for problems uploading or downloading any Contest related information from the website or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic entry submission to be received by the Promotor on account of technical problems, traffic, congestion on the internet or the website, or any other technical problems related to web site entries including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit a Nominee’s or a Nominator’s ability to participate in this Contest. If applicable, mass entries or entries generated by a script, robot, macro, or use of automated devices will be disqualified. Promotor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes beyond Promotor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Promotor reserves the right at its sole discretion to disqualify any individual they find to be tampering with the entry submission process or the operation of this Contest or web site or to be acting in violation of the Official Rules.
Without limiting any other right or term herein, a Nominator or a Nominee may be disqualified from the Contest if, in Promotor’s absolute discretion, it reasonably believes either of them has, appears to, or has attempted to undermine the legitimate operation of the Contest by cheating, deception, fraud, using multiple identities, engaging in illegal activities, or other unfair practices, or has or attempts to annoy, abuse, threaten, harass or intimidate any other participant, or any other person.
I) Grand Prize:
One (1) grand prize (hereinafter “Grand Prize”) consisting of an international volunteering trip to a Cityzens Giving project in July 2019, followed by attendance at one (1) match during the Manchester City 2019/20 pre-season tour, along with a meet & greet with selected Manchester City players. The trip consists of round-trip coach economy class air transportation for the potential winner Nominee and its Nominator (i.e., a total of two (2) traveler’s) from the major gateway airport nearest the potential winner’s home to the metropolitan area closest to the chosen Cityzens Giving project and closest to the match day city, bed and breakfast accommodation, meals and all costs related to the activities named in this section (location of the Cityzens Giving project, accommodation, airport, carrier and airline ticket class selected at the sole discretion of Promoter and Manchester City.)
II) Finalists Prizes:
The two runners-up (“Nominee and Nominator”) who did not win the Grand Prize will each receive a 500 € (Five hundred euros) voucher for the Manchester City online store and two (2) all game packages (accommodation, transfer, match tickets).
IMPORTANT NOTICE FOR GRAND PRIZE AND FINALISTS PRIZES (hereinafter “Travel Prize” or “Travel Prizes”): All other transportation, meals, gratuities, and all costs and expenses relating to or arising directly or indirectly out of the Travel Prizes not specified as included herein are the sole cost and responsibility of Travel Prizes winners. Included are visa costs and travel insurance in accordance with general practices. Travel Prizes must be taken on dates and times specified by the Promoter, the dates and times are subject to change. All travel arrangements are made through a travel agent or entity or Manchester City selected by the Promoter and the winner hereby acknowledges that specific Terms and Conditions related to the trip may apply. Specific air carrier(s), lodging providers and other trip specifics are at the sole discretion of the Promotor. Travel must originate and end at the same major gateway airport. The Travel Prizes winners will be required to provide valid travel documents and passports, including visas if applicable, valid photo IDs, and inoculations as required by travel authorities at time of travel; and, to obtain and maintain all insurance (including health, liability and any other insurance) and where in their state country still considered a minor, all necessary consents of their parental authorities. The Winner acknowledges and agrees that the Promoter is not a provider/carrier of transportation, or insurance provider. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. Prize conditions may be added or modified by the Promotor. The Promotor is not responsible for any changes of any element of the Travel Prizes including but not limited to any expenses incurred because of missed flights, flight charges, cancellation, or delays. The Promotor will not replace any lost or stolen tickets, travel vouchers, or certificates. Any unclaimed and/or unused element of a Travel Prizes will remain the property of Promotor. In the event a Travel Prizes winner engages in a behavior that, as determined by the Promotor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, illegal, disorderly, or that is intended to annoy, abuse, threaten or harass any other person, Promotor reserves the right to terminate the Travel Prizes trip early, in whole or in part, and to send the winner home with no further compensation.
The Travel Prizes winner are responsible for all federal, state, local, sales, income taxes and all expenses not specified herein. The Travel Prizes winner may be required as a condition of receiving the prize to provide the Promotor with his or her social security number so that appropriate reports may be filed with the appropriate tax authorities. If, for reasons beyond their control and not related to the Entry, the Promotor is unable to award the Travel Prizes as described in these Official Rules, they will substitute a Travel Prizes of similar nature and equal or greater value at their sole discretion. The Travel Prizes are non-assignable and non-transferable. The Travel Prizes are not redeemable for cash except as indicated above. A winner is not a recipient of the Travel Prize until he/she has been verified or notified as a winner by the Promotor or Jury, if selected, the Travel Prize winner is unable to accept the prize in its entirety, the selected Travel Prize winner will forfeit the Travel Prize, and the Travel Prize may be awarded to an alternate winner.
Entrants acknowledge that the Promotor and all other businesses concerned with this Contest and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Travel Prizes except that the prize shall be subject to manufacturer’s/provider’s standard warranty.
III) Nominator Prizes:
After the submission phase, the Promoter will raffle two (2) lots of two (2) tickets for a Manchester City game and tow (2) voucher for the Manchester City merchandise shop in the amount of 500 Euro each for the Nominators. Winners will be notified by no later than 31 March.
IV) SAP & Manchester City Community Heroes/Nominees Prizes:
After the voting phase the Promoter will raffle twenty (20) signed Manchester City Jerseys between the Nominees that were not selected as winners. Winners will be notified by no later than 30 June.
V) Voter Prizes:
After the voting phase the Promoter will raffle two (2) lots of two (2) tickets for a Manchester City game and two (2) voucher for the Manchester City merchandise shop in the amount of 50 Euro each for those that vote for the finalists. Winners will be notified by no later than 30 June.
VI) General Notices for Nominator Prizes and Manchester City Heroes Prizes:
The Promoter will attempt to notify each potential winner via direct message to the potential winner’s Facebook account or email address, whatever is available (the “Prize Notification”) within 24 hours following each raffle. If any potential winner does not respond to any such Prize Notification within twenty-four (24) hours of notification, does not meet the eligibility requirements set forth herein, is not in compliance with the Official Rules, fails to submit any identification required by Promoter, declines the prize for any reason, or is disqualified, the prize may be forfeited and, at the Promoters sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible Entries or votes received. If a Canadian resident wins a prize from a raffle, that person must answer correctly within a 5-minute time period a mathematical skill-testing question without the benefit of any calculating devices, before the prize will be awarded. Each winner will be required to provide his/her name, address and age in order to receive the prize (through direct message, email or other secure, private means). All personal information obtained by the Promoter and its agencies will be used solely for the administration of this Contest/Raffle and will be deleted and/or destroyed after the Raffle is completed. There is no entitlement to participate and the Promoter is entitled to refuse participation without any indication of reasons. SAP SE reserves the right to cancel or end the Contest at any given moment without any preannouncement or cause. The Promoter is entitled to cancel or end the Contest without any preannouncement if the proper execution of the Contest/Raffle is not guaranteed due to technical or legal reasons.
The prizes will be delivered to the address notified by the Winner by the Promoter within 30 days. All costs for delivery will be paid for by the Promoter. Any other costs and expenses associated with the acceptance of the prize are the sole responsibility of each individual winner. The prizes are non-transferable and non-assignable. Each prize is not redeemable for cash or transferable; prizes may not be sold or transferred for commercial use. No substitution allowed except that the Promoter may, at its sole discretion, substitute a prize with another of equal or greater value. All taxes are solely the responsibility of each winner. If transportation to an event venue is necessary and extra costs, such as lodging, and food and beverage may occur, these are the sole responsibility of the respective winner and will not be paid by the Promoter. There is no right to appeal.
The Nominator and the Nominee acknowledge that the Promoter and all other businesses concerned with this Contest, the Raffle and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness merchantable quality or merchantability of any aspect of the prizes.
By participating in the Contest and submitting an Entry, each entrant agrees: (a) to be bound by these Official Rules, including all entry requirements; and, (b) to the extent permissible by law, to waive any and all claims against the Promoter, Facebook and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Promoter”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt or use of any prize (or any portion thereof) or any travel or activity related to the receipt or use of any prize (or any portion thereof), except where Promoter acts with willful misconduct.
This Section 7 outlines how we handle information that can be used to directly or indirectly identify an individual ("Personal Data").

Facebook Ireland may be collecting the Nominees Personal Data in connection with a visit or interaction of the Nominees with the Contest and its content. Regarding Insights Data, Facebook Ireland is primarily responsible and the Nominees can view the joint controllership agreement on https://www.facebook.com/legal/terms/page_controller_addendum.
All personal data that participants (Nominators, Nominees, Voters) sent to the Promoter will be processed in compliance with data protection regulations, including the provisions of the EU General Data Protection Regulation (EU) 2016/679 ("GDPR") and Germany’s Federal Data Protection Act (BDSG). In this context, the Promoter undertakes to use the personal data entrusted to Promoter only for the specific intended purpose and to take appropriate technical and organizational measures to guarantee a suitable level of protection. For more information about personal data processed by the Promoter, refer to the data protection policy. You may withdraw your participation at any time. To withdraw your participation, please send an e-mail to firstname.lastname@example.org. After we receive your withdrawal notice, we will delete your personal data immediately.
For any potential legal dispute regarding the Contest, the German courts are responsible. The Promoter is solely liable to the law of the Federal Republic of Germany.
If one of the clauses of the term and conditions is ineffective or partially not effective, the efficiency of the other clauses is not affected hereby.
